Terms of service
These terms govern use of Big Spinning Wheel. By creating an account or otherwise using the service, you agree to these terms.
1. The service
Big Spinning Wheel lets users create spin-the-wheel pages, share them by public link, enable public embeds, invite collaborators with view, spin, or edit permissions, let public visitors view, spin, and see the current or latest spin result on public wheel surfaces when one exists, and allow landed segment availability changes according to the settings chosen by the wheel owner.
2. Eligibility and accounts
- You must be at least 13 years old to use the service.
- If you are under 18, you represent that you have permission from a parent or guardian.
- You are responsible for keeping your credentials secure and for activity under your account.
- We may offer password login, passkeys, MFA, and recovery options. You are responsible for using them appropriately.
3. User content
User Content includes wheel names, segments, settings, descriptions, profile or display names, content submitted by owners, collaborators, or other authorized users, and anything else you submit or publish through the service. You are responsible for your User Content and represent that you have the rights needed to post it.
You grant Big Spinning Wheel a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, display, and distribute your User Content as needed to operate and improve the service, including making it available according to the wheel's current sharing, collaboration, public-link, public-embed, and ownership-transfer controls, distributing enabled public embeds in external iframe and stream contexts, and handling it as reasonably needed for retention, moderation, safety, legal compliance, and service operations.
4. Public links, collaborators, and visibility
- Public links and public wheel surfaces are public. People may be able to access the wheel, public-facing settings, and the current or latest spin result when one exists.
- If you enable public embedding, the public wheel surface may appear on external websites, stream scenes, recordings, event pages, and other third-party contexts.
- If you embed a wheel in another site, tool, stream, recording, or event, you are responsible for that host context, including external access controls, notices, recording, tracking, audience permissions, and platform rules.
- If you show the recent spin recap to visitors, public wheel surfaces may also show recent spin history.
- If you enable landed segment disabling, collaborators or public live spinners may be able to disable the segment that landed, which changes the live wheel for future spins.
- If you add collaborators, they may access the wheel according to the permissions you grant, including optional edit access for wheel content, settings, and wheel-definition import/export actions.
- Only the current owner can rename, delete, manage collaborators, manage public links and embeds, or transfer ownership of a wheel.
- The current owner may transfer ownership only to a collaborator who has already joined and completes the transfer while signed in.
- Ownership transfer changes in-app control of the wheel record and service controls. It does not, by itself, transfer copyright, intellectual property, or other off-service rights in User Content unless the affected users separately agree.
- Standard public and authenticated viewer surfaces identify the current owner. Owner-selected wheel-only public embeds may hide title and owner chrome for compact display, but the embed remains a public wheel surface. Management surfaces may show collaborators or pending-transfer details to authorized signed-in users.
- Do not publish private or sensitive information in wheel names, wheel segments, or public profiles.
5. Prohibited conduct
- Do not use the service for unlawful activity.
- Do not post illegal, infringing, defamatory, hateful, harassing, or otherwise harmful content.
- Do not attempt to access or interfere with accounts or wheels you do not have permission to access.
- Do not circumvent security controls or abuse the service through spam, scraping, denial-of-service activity, or similar behavior.
- Do not present outcomes from the service as certified, fair, or trustworthy for high-stakes use.
- Do not imply that Big Spinning Wheel sponsors, endorses, partners with, or officially supports your external site, stream, event, tool, or use of a third-party product unless we say so in writing.
6. Randomness and fairness disclaimer
The service is not designed, tested, or certified as a random number generator or a fair selection tool. Wheels can be biased or manipulated intentionally or unintentionally, and outcomes may be affected by configuration, software defects, performance issues, or user actions.
7. Third-party services
The service may rely on third-party infrastructure, including hosting, storage, email delivery, and security services. We are not responsible for outages or failures caused by third-party services.
References to third-party tools such as OBS, Zoom, or iframe-capable hosts are setup conveniences only. Those services are not affiliated with or endorsed by Big Spinning Wheel, and compatibility, availability, and host support can change.
8. Suspension and termination
You may stop using the service at any time. We may suspend or terminate access at any time if we believe you violated these Terms or if suspension is reasonably necessary to protect the service, users, or legal compliance.
9. Disclaimer of warranties
To the maximum extent permitted by law, the service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement, or that the service will be uninterrupted, secure, error-free, or accurate.
10. Limitation of liability
- To the maximum extent permitted by law, Big Spinning Wheel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or business interruption.
- To the maximum extent permitted by law, Big Spinning Wheel's total liability for any claim relating to the service will not exceed the amount you actually paid us for the service in the 12 months before the event giving rise to the claim. If you did not pay for the service, that amount is $0.
- Some rights and remedies cannot be waived under certain laws, so some or all of the above may not apply to you.
11. Indemnity
You agree to indemnify and hold harmless Big Spinning Wheel, its owners, employees, and agents from claims arising out of your use of the service, your User Content, or your violation of these Terms.
12. Governing law and venue
These Terms are governed by the laws of the State of California, excluding conflict-of-law rules. Unless a law requires otherwise, disputes will be brought in state or federal courts located in California.
13. Changes to these Terms
We may update these Terms from time to time. The effective date above shows when they last took effect. If changes are material, we may provide additional notice before the changes take effect.
