Terms of Service

These Terms of Service govern registered-account use of Big Spinning Wheel. You agree to them only when you submit the affirmative Terms acceptance form. Public visitors may browse available public surfaces without creating an account or submitting that form, subject to the notices and restrictions presented on those surfaces.

1. The service

Big Spinning Wheel lets users create spin-the-wheel pages, share them by public link, enable public embeds, invite collaborators with view, spin, or edit permissions, let public visitors view, spin, and see the current or latest spin result on public wheel surfaces when one exists, and allow landed segment availability changes according to the settings chosen by the wheel owner.

The service operates without revenue and is provided for entertainment and low-stakes use. That fact does not change the responsibilities, limits, or rights in these Terms. Features and availability may change, and we may discontinue all or part of the service as described in Section 10.

2. Eligibility, registration, and accounts

  • You must be at least 13 years old to use the service.
  • If you are under 18, you represent that you have permission from a parent or guardian.
  • You are responsible for keeping your credentials secure, controlling access to your account, and activity you conduct or authorize through it, including delegated activity described in Section 6.
  • We may offer password login, passkeys, MFA, and recovery options. You are responsible for using them appropriately.
  • Registration requires email verification and may include other eligibility or security checks. We may decline or limit registration to protect the service, prevent abuse, comply with law, or for another lawful reason.
  • Creating an account requires your affirmative acceptance of the current Terms. See the Privacy Policy and Notice at Collection for information about registration data and retention.

3. Terms acceptance and electronic records

These Terms require your affirmative agreement. The Privacy Policy, Notice at Collection, and Copyright Complaints and Removal Policy are disclosures and do not become separate contracts merely because they are presented. This does not limit applicable privacy rights or other rights and obligations imposed by law.

By affirmatively accepting these Terms through the acceptance form, you agree to them and intend to sign and conduct that acceptance transaction electronically. We may keep electronic records of your acceptance.

This electronic-signature intent applies to this acceptance transaction. It does not by itself establish consent to receive every legally required notice electronically.

Acceptance records may remain after your account is deleted. See the Privacy Policy for information about their collection, disclosure, access, deletion, and retention.

4. User content

User Content includes wheel names, segments, settings, descriptions, profile or display names, content submitted by owners, collaborators, or other authorized users, and anything else you submit or publish through the service. You retain whatever ownership rights you hold in your User Content. You are responsible for your User Content and represent that you have the rights needed to post it.

You grant Big Spinning Wheel a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, display, and distribute your User Content only as needed to operate, maintain, secure, and moderate the service and carry out sharing you request, including through its collaboration, public-link, public-embed, and ownership-transfer controls.

When your contribution is deleted, your account is closed, your collaborator access ends, or a wheel is transferred, this license survives only for copies retained as necessary for those limited service purposes or to meet legal obligations, and only for as long as those copies are necessary for those purposes or obligations.

To the extent permitted by law, we may refuse to host, remove, delete, or disable access to any User Content, wheel, public link, or embed at our discretion, including for suspected violations of these Terms, legal or rights-related concerns, safety, abuse prevention, service changes or discontinuation, or any other lawful reason. We may do so without prior notice unless applicable law requires notice. These rights are not limited to copyright complaints or a finding that you violated these Terms.

We may screen or monitor User Content, but, except as required by law, we are not obligated to do so or to complete an investigation or reconsideration process before restricting or removing content. Except as required by law, we do not guarantee that removed content will be preserved, recoverable, or restored. Keep your own copies of content you wish to retain. Removing content does not expand our license to it or override applicable privacy, retention, or deletion requirements.

  • Public links and public wheel surfaces are public. People may be able to access the wheel, public-facing settings, and the current or latest spin result when one exists.
  • If you enable public embedding, the public wheel surface may appear on external websites, stream scenes, recordings, event pages, and other third-party contexts.
  • If you embed a wheel in another site, tool, stream, recording, or event, you are responsible for that host context, including external access controls, notices, recording, tracking, audience permissions, and platform rules.
  • If you show the recent spin recap to visitors, public wheel surfaces may also show recent spin history.
  • If you enable landed segment disabling, collaborators or public live spinners may be able to disable the segment that landed, which changes the live wheel for future spins.
  • If you add collaborators, they may access the wheel according to the permissions you grant, including optional edit access for wheel content, settings, and wheel-definition import/export actions.
  • Among users, only the current owner can rename, delete, manage collaborators, manage public links and embeds, or transfer ownership of a wheel. This does not limit our rights to restrict or remove content or discontinue the service under Sections 4 and 10.
  • The current owner may transfer ownership only to a collaborator who has already joined and completes the transfer while signed in.
  • Ownership transfer changes in-app control of the wheel record and service controls. It does not, by itself, transfer copyright, intellectual property, or other off-service rights in User Content. A separate transfer of those rights must meet applicable legal requirements.
  • Standard public and authenticated viewer surfaces identify the current owner. Owner-selected wheel-only public embeds may hide title and owner chrome for compact display, but the embed remains a public wheel surface.
  • Do not publish private or sensitive information in wheel names, wheel segments, descriptions, or public profile names.

6. Profile-enabled browser and AI-assistant tools

WebMCP is off by default. If you enable it in your Profile, eligible signed-in pages may expose tool descriptions, page-specific capabilities, and catalog values to a compatible browser or AI assistant you select. Tools may use your signed-in session to perform supported actions, subject to your account permissions and the service's access controls.

You are responsible for the authority you grant to a browser or assistant, including your instructions, permission settings, standing permissions, and any authority to act without further confirmation. You are responsible under these Terms for actions taken through WebMCP within the scope of that authority, including submissions, changes, and disclosures of User Content. The absence of a separate approval for a particular invocation does not, by itself, make an action outside the authority you granted.

Depending on the provider and your settings or instructions, tools may be invoked under previously granted authority without a fresh prompt or human approval for each invocation. Do not assume that every action will be separately presented for review. Review and limit the authority you grant, monitor resulting activity, and review outputs before relying on them. You can disable WebMCP in your Profile and use available provider controls to manage or revoke permissions. Disabling the feature or revoking permissions does not, by itself, undo completed actions or delete information already received by a provider.

This allocation of responsibility does not deem an action authorized merely because it occurred through your session, waive rights you may have concerning unauthorized activity, or excuse liability that cannot lawfully be excluded. Enabling WebMCP does not itself constitute acceptance of these Terms or a later revision; the affirmative acceptance requirements in Sections 3 and 15 still apply.

The browser or assistant provider is a separate third party governed by its own terms, privacy practices, settings, retention, and model-training practices. Big Spinning Wheel does not select that provider, and enabling WebMCP does not make that provider our service provider. 7. Prohibited conduct

  • Do not use the service for unlawful activity.
  • Do not post illegal, infringing, defamatory, hateful, harassing, or otherwise harmful content.
  • Do not attempt to access or interfere with accounts or wheels you do not have permission to access.
  • Do not circumvent security controls or abuse the service through spam, scraping, denial-of-service activity, or similar behavior.
  • Do not present outcomes from the service as certified, fair, or trustworthy for high-stakes use.
  • Do not imply that Big Spinning Wheel sponsors, endorses, partners with, or officially supports your external site, stream, event, tool, browser, AI assistant, or other third-party product unless we say so in writing.

8. Disclaimer

Entertainment only

Big Spinning Wheel is for entertainment and low-stakes use only.

No guarantee of randomness or fairness

We do not guarantee that any spin or outcome will be random, fair, unbiased, unpredictable, or suitable for a particular selection purpose. Outcomes may be affected by wheel configuration, probability weights, user actions, software defects, performance issues, or intentional or unintentional manipulation. Do not treat the service or its outcomes as certified or independently verified for randomness or fairness.

Not for important decisions

Do not use Big Spinning Wheel for decisions involving health, safety, medical care, legal rights, finances, employment, educational placement, or any other high-stakes situation.

User content may be inaccurate or offensive

Wheel names, segments, and other User Content are user-created. They may be inappropriate, offensive, misleading, illegal, or simply wrong. We do not guarantee that User Content is accurate, truthful, or safe.

If you share a wheel by public link or enable public embedding, public wheel surfaces may show the wheel, owner display, current or latest spin result state when one exists, and, if allowed by the owner, spin controls on Big Spinning Wheel or external sites and streams. Do not include private or sensitive information in wheel content.

9. Third-party services

The service may rely on third-party infrastructure, including hosting, storage, email delivery, content moderation, monitoring, diagnostics, security, and timestamp services. We are not responsible for outages or failures caused by third-party services.

References to third-party tools such as OBS, Zoom, compatible browsers or AI assistants, or iframe-capable hosts are setup conveniences only. Those services are not affiliated with or endorsed by Big Spinning Wheel, and compatibility, availability, host support, and provider practices can change.

10. Service changes, discontinuation, suspension, and termination

You may stop using the service at any time.

To the extent permitted by law, we may modify, limit, suspend, or discontinue all or any part of the service, temporarily or permanently, at any time and for any lawful reason, including operational or business reasons, whether or not any user has violated these Terms. We do not promise that any feature, wheel, public link, embed, or account will remain available. We may take these actions without prior notice unless applicable law requires notice.

We may also suspend or terminate your access or account if we believe you violated these Terms, if reasonably necessary to protect the service or users or comply with law, or in connection with service discontinuation. Except as required by law, we are not required to provide advance notice, an opportunity to cure, or a particular review process before doing so.

These actions may make your account, User Content, public links, embeds, or exports unavailable. Keep your own copies of content you wish to retain. Except as required by law, we do not guarantee continued hosting, an export period, recovery, or restoration. Any liability remains subject to Sections 11 and 12 and applicable law; this section does not exclude liability that cannot lawfully be excluded.

Content licenses and retained copies remain subject to Section 4. Personal-information handling remains subject to the practices described in the Privacy Policy and applicable law. Nothing in this section limits a notice, refund, access, deletion, or other right or remedy that cannot lawfully be waived.

11. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR ACCURATE.

12. Limitation of liability

  • To the maximum extent permitted by law, Big Spinning Wheel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or business interruption.
  • To the maximum extent permitted by law, Big Spinning Wheel's total liability for any claim relating to the service will not exceed the amount you actually paid us for the service in the 12 months before the event giving rise to the claim. If you did not pay for the service, that amount is $0.
  • Some rights and remedies cannot be waived under certain laws, so some or all of the above may not apply to you.

13. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Big Spinning Wheel, its owners, employees, and agents from claims arising out of your use of the service, your User Content, or your violation of these Terms. For WebMCP activity, this obligation applies to actions within the scope of the authority you grant as described in Section 6; it does not impose responsibility for an unauthorized action merely because it occurred through your session.

14. Governing law and venue

These Terms are governed by the laws of the State of California, excluding conflict-of-law rules. Unless a law requires otherwise, disputes will be brought in state or federal courts located in California.

15. Changes to these Terms

We may update these Terms from time to time. We will make the updated Terms and their effective date available through the service and provide any notice required by applicable law. Material changes require your affirmative acceptance before they apply to your account and before you may continue using account features that require agreement to the updated Terms. If you do not accept, you may stop using the service and may be unable to continue using those features. Merely continuing to use the service does not substitute for required affirmative acceptance.
